1. PURPOSE
These Terms and Conditions (hereinafter, T&C) regulate the rewards program for Bit2Me Card users and, together with the Privacy Policy, will govern the relationship between users, Merchants (partners), and Bit2Me.
The rewards program is managed by Bit2Me in collaboration with Merchants, who provide Bit2Me's platform with available offers and promotions from which users can access rewards.
2. REQUIREMENTS FOR USING THE REWARDS PROGRAM
This program is accessible to individuals who are of legal age according to Spanish law, have full contractual capacity, are Bit2Me Card users, and accept these T&C, as well as the Privacy Policy associated with this service.
Becoming a User implies reading and expressly accepting, without reservation, the terms included in these Terms and Conditions, which they declare to have known prior to their acceptance, and which may be stored and reproduced by them.
To use the rewards program, Bit2Me will specify the data required (such as user ID etc.) by the merchants, as outlined in the specific conditions set forth in these terms and conditions.
The user can access the Service through the Platform by accepting the T&C and Privacy Policy.
On the Bit2Me platform itself, the user can view all available offers and promotions.
When the user makes a purchase using the Bit2Me card, the user's identification details and transaction data will be sent.
The Merchant will inform Bit2Me whether that transaction has an associated reward and the amount of it. If there is a reward, it will be held by Bit2Me. Once the reward amount is confirmed, Bit2Me will deposit it in B2M to the user (a deposit in Fiat and automatic conversion to B2M may appear in the wallet). This reward may take 1 to 7 days to be confirmed.
3. RIGHT OF WITHDRAWAL
In accordance with Article 103.d) of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the right of withdrawal will not apply to contracts for the supply of goods that are liable to deteriorate or expire rapidly.
If a purchase eligible for a refund is returned, the reward may be canceled or, if already deposited into the user's B2M account, it may be deducted from it.
4. EXCLUSIONS OF LIABILITY
Neither the Merchants nor Bit2Me are responsible for the products and services purchased that generate these rewards; responsibility for acquired products or services will depend on the Platform or business from which they were purchased, rented, or contracted.
Merchants and Bit2Me shall be released from any liability in case of improper use by the User.
Merchants and Bit2Me will not assume any responsibility for damages or losses that may be suffered as a result of unforeseen events, or events that, even if foreseen, were unavoidable, whether due to chance or force majeure.
Merchants and Bit2Me are not responsible for any failures, technical errors, accidents, breakdowns, tampering, service interruptions, or any other incidents that may arise in products, equipment, or technical services external to Merchants and Bit2Me whose use is necessary for the provision of the Service.
Merchants and Bit2Me will not be liable in cases of service unavailability due to force majeure or temporary suspension for technical reasons.
5. INTELLECTUAL AND INDUSTRIAL PROPERTY
The Platform, its source code, and the content it hosts are protected by national and international intellectual and industrial property laws. They may not be exploited, reproduced, distributed, modified, publicly communicated, assigned, or transformed, unless expressly authorized in writing by the rights holders.
The design, images, labels, distinctive signs, trade name, trademarks, logos, products, and services contained on this Website are protected by Industrial Property law.
Access to this Website does not grant users any right or ownership over the intellectual or industrial property rights or the content it hosts. Users accessing this Website may not copy, modify, distribute, transmit, reproduce, publish, assign, or sell the aforementioned elements or create new products or services derived from the information obtained without express written authorization.
Any alteration of the content or structure of this Website by the user is strictly prohibited.
Merchants and Bit2Me reserve the right to take appropriate legal action against users who violate or infringe intellectual and industrial property rights.
6. PERSONAL DATA PROTECTION
In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights (LOPDGDD), and any other applicable data protection regulations, we inform you that the personal data provided during the registration process will be processed and included in an information database, the purpose of which is the management of the services included in these T&C and the processing of requests and rewards for Users of our offered services.
To offer the Rewards Program, the following two entities act as Data Controllers:
- PAYLEAD, a simplified joint-stock company, with registered office at 9, rue de Condé 33064 Bordeaux (France), registered with the Bordeaux Trade and Companies Register (RCS) under number B 821 725 579.
- BITCOINFORME, S.L. (Bit2Me), with registered office at Calle Germán Bernacer, 69, 03203, Elche, Alicante, SPAIN, and with Tax ID: B-54835301.
The personal data processed for the development of this rewards service are as follows:
- Bank account references
- Bank transactions
- User ID
- IP address
- Bit2Me card ID
The User guarantees that they are the owner of the personal data provided and that it is authentic. The user will be responsible for the consequences of providing false data. In case of any variation in the data provided, the user undertakes to communicate it through the process enabled for this purpose on the Platform.
The data subject has recognized rights to access, rectification, erasure, restriction, objection, and data portability regarding their data under the responsibility of the PARTIES. As long as the purpose of data processing exists or you have not expressly deleted your personal data from our common database, we will continue to process your data as it is necessary for processing and you remain interested in being part of it. At any time, the data subject may exercise their rights by sending postal communication to the PARTIES at the addresses indicated above or via email to rgpd@bit2me.com or dpo@paylead.fr, attaching a document proving their identity and explicitly stating the right they wish to exercise.
The data subject is protected by the right to withdraw their consent for the processing of their data. Furthermore, they have the right to address their complaints derived from the processing of their personal data to the Spanish Data Protection Agency (www.agpd.es).
7. PLEBICOM SPECIFIC TERMS AND CONDITIONS
7.1 PLEBICOM is a Bit2Me partner provider that brings users promotions, offers, coupons, and cashback rewards offered by various online merchants adhering to the program. PLEBICOM is a simplified joint-stock company, with registered office at 131 Boulevard de Sébastopol, 75002 Paris, France, registered with the Paris Trade and Companies Register under number 433 817 111 R.C.S. Paris.
7.2 To use the rewards program associated with PLEBICOM, Bit2Me may share with PLEBICOM the necessary data to identify the activation of an offer, track the purchase, and determine whether a reward is applicable. Such data may include:
- User ID.
- Identifier of the selected offer, merchant, or partner.
- Click or tracking identifier.
- Information related to the purchase made when communicated by the merchant or provider.
- Purchase amount, currency, transaction date, and reward validation status.
- User segment, where applicable for the availability of certain offers.
The User can access the service through the Bit2Me Platform, where they can view available offers and promotions, access the details of each one, and activate the selected offer before being redirected to the corresponding merchant.
Once the purchase is made, PLEBICOM will inform Bit2Me if the operation has an associated reward, as well as the applicable amount or percentage and its status. The reward may initially appear as pending until it is confirmed or rejected by the merchant or by PLEBICOM, according to the specific conditions of each offer.
If the reward is validated, Bit2Me will credit the User with the corresponding amount as per the Platform's operation. In case of a return, cancellation, non-compliance with the offer conditions, or lack of confirmation by the merchant, the reward may be canceled, rejected, or deducted if it has already been credited.
