These ST&C are a supplement to the GT&C and Privacy Policy of Bit2Me and must necessarily be accepted together with the General Terms and Conditions of Contract "card" of PECUNIA CARDS EDE, S.L.U. ("PECUNPAY")


TABLE OF CONTENTS


  1. INTRODUCTION

These Specific Terms and Conditions of the Bit2Me Card product ("Specific Terms") govern the contractual relationship between You ("user") and Bit2Me", while You and Bit2Me are hereinafter referred to separately as "Party" and jointly as "Parties", with respect to your use of the Bit2Me Card Product, and constitute a legally binding contract ("Agreement") between the parties.

In order to provide the Bit2Me Card service, Bit2Me has partnered with PECUNIA CARDS EDE, S.L.U., an Electronic Money Institution supervised by the Bank of Spain and registered with number 6707, whose trade name is "Pecunpay". Pecunpay is the issuer and manager of the Bit2Me payment card and account. If the user has any problem related to the operation of the card, they should contact the payment service provider through the following email address: servicioatencioncliente@pecuniacards.es 

  1. DEFINITIONS

In this document, reference will be made to the Specific Terms and Conditions of Bit2Me Card. All previously defined terms used in these Specific Terms shall have the same meaning as that given to them in the GENERAL TERMS AND CONDITIONS OF THE BIT2ME PLATFORM SERVICES.

  1. USERS

This Agreement may be entered into and the Bit2Me Card Product may be used only if all of the following conditions are met:

  1. You have registered on the Bit2Me platform, opened an account and accepted the GENERAL TERMS AND CONDITIONS OF THE BIT2ME PLATFORM SERVICES and the PRIVACY POLICY. Likewise, you must have accepted the General Terms and Conditions of Contract "card" of PECUNIA CARDS EDE, S.L.U. ("PECUNPAY") available at: https://bit2me.com/legal/pecunia


  1. You represent and warrant that any cryptoasset stored for the purpose of using the Bit2Me Card services is your property or that you are fully authorized to transact using such cryptoassets without restrictions or limitations. That the use of the services is solely for your own account and benefit, and not on behalf of any other person or entity. In addition, you represent and warrant that all such cryptoassets are free from any third-party claims, debts, liens, or rewards or bonuses.

  2. You are not a citizen or resident of (United States, Japan, Afghanistan, North Korea, Cuba, Guinea Bissau, Iran, Iraq, Syria, and Tajikistan), and you have no relevant connection to any jurisdiction where Bit2Me or its legislation has prohibited or restricted access to the Bit2Me Card services;

  3. Carry out the identity verification tests of the Bit2Me platform.

  4. By accepting these Specific Terms and Conditions (ST&C) you acknowledge and confirm that you meet all the conditions set forth above. In the event that it is later determined that you have not met or no longer meet any of these conditions, we may suspend the Bit2Me Card services and/or related services and close your account on the Bit2Me platform.

  5. Likewise, Bit2Me may at any time and without liability to you:

    1. reject your request to use the Bit2Me Card services; change the conditions for entering into the Bit2Me Card services Agreement;

    2. suspend all or part of the Bit2Me Card services;

    3. Change, update, remove, cancel, suspend any feature, component, and content with the Bit2Me Card services.

  1. DESCRIPTION OF BIT2ME CARD

    1. SERVICE

Bit2Me Card is a state-of-the-art Mastercard that can be had in both plastic and virtual format. The plastic version has NFC technology. It has an exclusive design, authorized by Mastercard, and printed with high-quality inks.

Only one Bit2Me Card may be requested in the name of the same holder registered in the Bit2Me user account. This card is personal and non-transferable for the holder of the Bit2Me account, and its use by any third party is prohibited.

  1. OBTAINING THE PHYSICAL CARD

The User, through the Bit2Me application, in the "Card" section, may request their physical card; for this, they will provide a postal address to receive the Bit2Me Card at the indicated address. The card delivery time will depend on the contracted courier service, and Bit2Me cannot offer the User any specific timeframe to receive it. The card will be sent within 15 calendar days.

  1. ACTIVATION OF THE PHYSICAL CARD

Through the Bit2Me mobile application, the user, once they receive the card at the indicated address, can activate it by entering the last 4 digits of the card, which also appear on the back of it, and following the instructions of the mobile application.

  1. OBTAINING THE VIRTUAL CARD

The User must request the virtual card through the Bit2Me app, by accessing the "Card" section of the side menu, clicking on the 'Virtual' tab, and then clicking on the 'I want my virtual card' bar.

  1. ACTIVATION OF THE VIRTUAL CARD

To activate the virtual card, the user will have to access the "my cards" section from the application and click on the "Activate" option.

After requesting the first Bit2Me card, whether physical or virtual, the User must set an alphanumeric secret code that will be requested when making online transactions. With this, the Payment Services Directive 2 (PSD2) aims to improve security and reduce fraud in transactions. This code is unique and will be associated with all of the User's cards. The steps to follow to set it up are as follows:

1. The user must go to the "Card" section in the side menu of the app.

2. The User can start the process of setting up the secret code in two different ways:

2.1. Through the "set secret code" button that will be seen on the main screen of your cards section.

2.2. By entering the general settings of your cards, through the menu located in the upper right corner of the screen. From there, select "Create secret code". If the User later wishes to modify their code, they can do so from this same section.

3. Regardless of the path chosen previously, the next step will be to enter the code that will arrive by notification to the phone that the User has configured in the app.

  1. SUPPORTED CRYPTOASSETS

Currently, the cryptoassets compatible with the Bit2Me Card service are those indicated below and are subject to review by Bit2Me at her sole and absolute discretion, and this list may be expanded or reduced at any time.

  1. USE OF THE CARD

The Bit2Me Card is subject to the uses set out in the Pecunpay T&Cs and, according to them, can be used in stores worldwide, for online purchases, and to withdraw cash, provided that, in the three indicated modes of use, they operate with the Mastercard brand.

To use the card, the user will have to link it with their cryptoasset funds wallet in their Bit2Me account, or with their cryptoasset funds wallet in Bit2Me Earn specified in the list indicated in the previous section with which they wish to pay, so that Bit2Me can proceed with the conversion to Euros and the payment can be made to the Third Party through the service contracted by the user with Pecunpay. The card only allows linking with the aforementioned cryptoasset wallets. The user will have to change the configuration of the linked wallet through the application by selecting the desired wallet. This action has no additional cost.

The funds from the users' Wallet that have been converted to euros by Bit2me will be transferred to Pecunpay to proceed with the payment.

The user may make payments in both online stores and physical stores.

When proceeding to use the Bit2Me Card, the linked cryptocurrencies are converted to euros at the price of said cryptocurrency at that moment. The user, by using the card, accepts that the aforementioned conversion takes place regardless of the knowledge they may have about the price of the cryptoasset used, without Bit2Me being in any way responsible for the volatility of the value of said cryptoasset.

Likewise, the user accepts and understands that, in the event that no activity is registered in the Bit2Me Card service (purchases, payments, or any other type of transaction) for a continuous period of three (3) months, Bit2Me reserves the right to cancel the virtual card service unilaterally and without prior notice. The physical card associated with the user's service will remain operational and will not be affected by this cancellation. In any case, the cancellation will be carried out in order to maintain the security and efficiency of the service, as well as to prevent possible fraud and misuse.

In case of cancellation, the user may request the issuance of a new virtual card at no cost in the manner provided at [bit2me.com/suite/card].

  1. CASH WITHDRAWALS

The withdrawal of cash from the account will imply, on the one hand, the automatic transformation of the funds in cryptocurrencies into electronic money, according to the market price at that time, and then the conversion into cash and, on the other hand, the pertinent annotation of said exchange and sending process in the HOLDER's Wallet. The cryptocurrency wallet cannot reflect a negative balance derived from the operations carried out by the HOLDER, so they will be obliged to have sufficient balance for each exchange and sending operation, including the accrued fees; otherwise, the operation will be denied, and the user must assign more cryptocurrencies or change wallets.

  1.  FEES

The Bit2Me card does not have any maintenance fees. The user will only pay the card issuance fee if they request the physical card.

Regarding transaction fees, no usage fee will be applied, but a 0.95% commission for the conversion to euros will be applied.

  1. REPORTING LOSS OR REQUESTING CANCELLATION

From the Bit2Me app, the user will have the option to turn their cards on and off, instantly and in a single click. If you believe your card may have been stolen or simply lost, the user has the possibility of deleting it from the application, in the options of the card itself. Once deleted, the User may request a new one.

The user may report the loss of the card through the official Bit2Me channels such as info@bit2me.comsupport@bit2me.com, or to the telephone numbers that appear on the Bit2Me website and on the back of the card. Likewise, the User must notify PECUNPAY of the loss, misplacement, theft, misappropriation, or forgery of the card through the communication channels established in its own terms and conditions as well as on its website.

  1.  REWARDS or CASHBACK

By using the card, the user will have access to different benefits, which can be consulted in their Space Center profile within the Bit2Me application.


These rewards or cashback will depend on several factors such as the user's Tier or level, whether payments are made using the B2M token, or even if payments are made to certain stores or businesses.


These benefits may be modified at the sole discretion of Bit2Me.


The User will see the delivery of the rewards reflected in their own wallet as a purchase of euros which will then be automatically converted into B2M.


Rewards will be received within minutes of making the purchase, with a maximum delivery time for rewards or cashback of 24 hours from the purchase.


In the event that the customer makes a full or partial return of the purchase, the percentage of cashback or rewards delivered will be deducted from the refunded amount.

Once the cashback or rewards delivered have been deducted, the conversion fee from euros to the cryptocurrency in the wallet linked to the card will be applied to said refund.

  1. HOLDS AND BLOCKS

The use of the card in certain businesses may lead to a hold or block on the user's balance. The period for lifting the block or hold will depend exclusively on the merchant. Bit2Me undertakes to transfer the retained balance to the user as soon as possible once it is unblocked by the merchant.

  1. EEA TERRITORY

The Bit2Me card will only be available within the EEA territory, although it will be possible to operate with it from anywhere in the world. However, it is possible that in certain countries within this area there may be other criteria that could lead to the non-issuance of the card, for example, Bonaire, Cyprus, Aland Islands, Liechtenstein, Mayotte, French Polynesia, and Réunion.

  1. OBLIGATIONS AND WARRANTIES

The user declares, warrants, and confirms that:

  1. The Cryptoassets, which you have transferred or will transfer to your Wallet in Bit2Me and that may be used through the Bit2Me Card, do not derive from money laundering and terrorist financing, fraud, or any other illegal or criminal activity under the Applicable Law in the respective jurisdiction;

  2. You have only sent complete, correct, and up-to-date information and documents to Bit2Me;

  3. You are aware that you are subject to the tax regulations of your jurisdiction and will be fully responsible for any declaration and payment of any tax owed to the competent tax authority, as required by Applicable Law. Bit2Me will not be obliged to compensate you for your tax obligations or to advise you in relation to your tax affairs. The uncertainty in tax legislation related to Cryptoassets may expose you to any current or future tax consequences associated with your holding of Cryptoassets and the use of Bit2Me's Services, for which Bit2Me will not be responsible.

  4. You are aware that you use the Bit2Me Card services at your own risk.

You hereby undertake to:

  1. Use the Bit2Me Card services in good faith;

  2. Not to violate what is stated in these terms and conditions or any Applicable Law in the corresponding jurisdiction;

  3. Not to commit any fraud, malicious act, or criminal activities;

  4. Not to provide incorrect, inaccurate, incomplete, outdated, or misleading information;

  5. Not to interfere with or intercept our network, system, data, or information;

  6. Not to upload any viruses or other malicious software or programs, nor attempt to gain unauthorized access to the accounts, website, network, or systems of other users related to the Bit2Me Card services;

  7. Not to reverse engineer or disassemble any of our programs, systems, or products, nor to infringe in any way on the intellectual property rights and/or those of our partners;

  8. Not to cause or launch programs or scripts for the purpose of indexing, surveying, or otherwise data mining any part of any of our programs, systems, or products, or unduly burdening or hindering the operation and/or functionality of any aspect of the Bit2Me Card service.

  9. The user may not lend, assign, sell, or otherwise transfer their card to a third party. In the event this scenario occurs, Bit2Me may, unilaterally, terminate this contract immediately.

Failure to comply with any of the points indicated in this clause, and especially any indication of fraud, will result in immediate unilateral termination by Bit2Me and therefore the blocking of your card.

  1. RISK INFORMATION

1.- Cryptoassets are more volatile in relation to most fiat currencies and other assets, and this unpredictability of their price can lead to significant losses in a short period of time. Bit2Me and Bit2Me Card are not responsible for the cryptoasset market, and we do not make any representations or warranties regarding the actual or perceived value of any digital asset, and the quality, suitability, truthfulness, usefulness, accuracy, or completeness of any information provided by Bit2Me or Bit2Me Card. Therefore, you are the one who should carefully consider whether holding cryptoassets is suitable for you in light of your financial condition.

2.- Cryptoassets are not money or legal tender in many countries, are not backed by the government or a central bank, and most do not have any underlying assets, income streams, or the like.

3.- The regulatory status of cryptoassets is not currently established, varies between jurisdictions, and is subject to significant uncertainty. Legislative and regulatory changes or actions related to cryptoassets or blockchain technology at the state or international level may negatively affect or restrict, as the case may be, the use, transfer, exchange, and value of cryptoassets, as well as the services of Bit2Me Card or Bit2Me. The value of cryptoassets may derive from the continued willingness of market participants to exchange fiat currencies for cryptoassets, which may result in the permanent and total loss of the value of the cryptoassets, particularly in the event that the market for them disappears.

4.- The nature of cryptoassets can lead to an increased risk of fraud or cyber-attacks and any loss due to fraudulent or accidental transactions that will not be recoverable.

5.- Bit2Me and Bit2Me Card do not provide investment advice, and information from Bit2Me and Bit2Me Card should not be used as a basis for making decisions about possible transactions or services to contract with a particular cryptoasset.

6.- The user is responsible for determining whether the use of the Bit2Me or Bit2Me Card service is legal in their jurisdiction and should refrain from using it if it is illegal in their jurisdiction. If you are unsure, seek independent legal advice.

7.- We may be forced to suspend, cancel, or change aspects and services of Bit2Me Card or Bit2Me in any jurisdiction without prior notice if required by regulatory authorities or by applicable law, or for another reason. In such a case, your cryptoassets may be frozen for an indefinite period of time until the matter is resolved.

8.- The user understands and agrees that they use Bit2Me and Bit2Me Card at their own risk. This clause is not exhaustive and does not disclose all the risks associated with cryptoassets and the use of the Bit2Me Card or related services. Therefore, the user must carefully consider whether its use is appropriate based on their specific circumstances and financial resources.

  1. LIMITATION OF LIABILITY

Bit2Me Card services are provided "as is" and without any warranty, whether express, implied, or statutory, except as expressly provided in these Specific Conditions, to the extent permitted by applicable law. Bit2Me and Bit2Me Card disclaim any other warranty, express or implied, made to you, your affiliates, or any third party, including without limitation, any warranty regarding quality, suitability, merchantability, or otherwise, of any service or any good provided incidentally to the Bit2Me Card product or service under these Specific terms.

Notwithstanding any provision in these terms and conditions, Bit2Me is not liable to you for losses, damages, or claims due to an unusual or unforeseeable event beyond our reasonable control, the consequences of which could not have been avoided even if all due care and diligence had been exercised (force majeure) or arising in connection with:

  1. Any delay, suspension, or interruption of the Bit2Me platform or the Bit2Me Card service;

  2. Failures or interruptions in public or private telecommunication networks, communication channels, or information systems;

  3. Acts or omissions of a party for which we are not responsible;

  4. Delay, interruption, or unavailability of third-party services;

  5. The user's inability to make or complete any transaction due to maintenance of the platform or system, a breakdown, or the unavailability of the Bit2Me platform or the Bit2Me Card service;

  6. Any unauthorized use of the Bit2Me platform contrary to these terms and conditions;

  7. Compliance with any applicable law, court orders, or acts of any governmental authority;

  8. Resulting from hacking, manipulation, transmission of computer viruses, or other unauthorized access or use of the Bit2Me platform;

Notwithstanding any provision in these terms and conditions, in no event shall we be liable to you for any incidental damages, whether direct or indirect, foreseeable or unforeseeable, including but not limited to loss of revenue, loss of profits, substitution of goods, loss of technology, loss of data, or interruption or loss of use of service, even if you have been advised of the possibility of such losses or damages and whether they arise as a result of contract or tort liability.

  1. TAX IMPLICATIONS

Within the Bit2Me platform, you can view a record of transactions related to your use of the services, which you can use to make any required tax declarations or payments. It is your responsibility to determine which taxes apply to your use of the Bit2Me Card services, if any, and to collect, report, and remit the correct tax to the appropriate tax authority. We may deduct or make any tax withholding or filing required by law, but we are not responsible for determining whether taxes apply to your transaction and which ones, nor for collecting, reporting, or remitting any tax arising from any transaction or in connection with your Bit2Me Account and Bit2Me Card. You are responsible for complying with applicable law. You agree that Bit2Me is not responsible for determining whether laws may apply to your transactions or which laws may apply, including tax laws. You are solely responsible for reporting and paying any taxes arising from your use of the Services.

  1. DATA PROTECTION AND PREVENTION OF MONEY LAUNDERING

The services provided by Bit2Me require the processing of personal data.

Bit2Me is committed to protecting privacy and providing a secure user experience. By contracting the services, the user explicitly accepts the processing of their data as described in the Privacy Policy established by Bit2Me at https://bit2me.com/legal/privacidad 

As established in section z) of article 2.1 of Law 10/2010 on the Prevention of Money Laundering and Terrorist Financing, the activity of Bit2Me as a provider of services for the exchange of virtual currency for fiduciary currency and for the custody of electronic wallets is subject to the aforementioned regulations on the Prevention of Money Laundering and Terrorist Financing.

Bit2Me fully complies with the current regulations on the prevention of money laundering and other supplementary regulations. To this end, Bit2Me informs you that said regulations require, among other obligations, to documentarily identify its users, collect information on the nature of their professional or business activity, and report, either at the request of the Executive Service of the Commission for the Prevention of Money Laundering and Monetary Infractions, or on its own initiative, any fact or operation regarding which there is an indication or certainty that it is related to money laundering.

To comply with its commercial activities and national and European legal obligations for payment services and other urgent financial matters and the national and European regulations on the Prevention of Money Laundering and Terrorist Financing, Bit2Me needs to collect personal data belonging to the user as established in its general conditions at the time of registration on the Bit2Me platform. Such data collected for compliance with the aforementioned regulations may be used by Bit2Me to provide the Bit2Me Card service.

In compliance with the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter GDPR), of the Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (hereinafter LOPDGDD) and any other applicable data protection regulations, we inform you that the personal data provided will be incorporated into a database owned and managed by Bit2Me, whose purpose is to manage the Bit2Me Card service offered by Bit2Me, the management of the contractual relationship, as well as the maintenance of commercial relations, based on the existing legal relationship and the legitimate commercial interest, respectively.

Personal data will be kept for the time necessary for the purpose indicated in the previous paragraph, and once it has ended, they will be kept at the disposal of the public administration, judges, and courts for the statute of limitations period of the actions that apply to the processing of your data. For any matter related to the processing of personal data by Bit2Me, you can send an email to rgpd@bit2me.com or contact our Data Protection Officer at the following email address dpd@bit2me.com.

You have the recognized right to exercise the rights of access, rectification, deletion, limitation, opposition, and portability of the data provided, which you can exercise by sending a written request to Calle Germán Bernacer, 65, 03203, Elche, Alicante, Spain - BIT2ME, Legal Dept., or by email to the address rgpd@bit2me.com. Likewise, we inform you that you have the right to object to processing for commercial purposes by Bit2Me and that you have the right to file a claim with the Spanish Data Protection Agency.

No data transfers or communications will be made except for the provision of services by third parties as data processors, with whom Bit2Me has signed the corresponding Data Processor contracts and verified that they meet sufficient guarantees to apply appropriate technical and organizational measures, so that the processing is carried out in accordance with the requirements of the GDPR, ensuring the protection of the rights of the data subject.

Likewise, we inform you that, in order to provide this service, your data (including those collected in the onboarding process -KYC-) will be transferred for processing by PECUNIA CARDS EDE S.L. (Pecunpay), also as Data Controllers, so it will be necessary to accept, in addition to these, the General Conditions of the service established by Pecunpay.

Furthermore, we also inform you that in order to manage the shipment of your physical card, if you have requested it, it is necessary to share certain personal data (name, surname, address, telephone, and email) with the courier company that will carry out the shipment to your address. The sole purpose of the transfer is to manage the shipment of the physical card, and the legal basis is the execution of the contract and the provision of the requested service. To exercise your rights related to your personal data, you can exercise them directly with the courier company responsible for the shipment. Bit2Me undertakes to fulfill its obligation of secrecy regarding personal data and guarantees the adoption of the legally required and necessary security measures that guarantee the security of personal data and prevent its alteration, loss, unauthorized processing, or access, taking into account the state of technology, the nature of the data, and the risks to which they are exposed.

  1. INTELLECTUAL PROPERTY

The Bit2Me Card service, the associated software, and technological tools, including but not limited to their programming, editing, compilations, designs, logos, text, and/or graphics, are the property of Bit2Me, and are protected by national and international regulations on intellectual and industrial property. Access by the user to the service does not grant them any ownership rights over them.

Therefore, Bit2Me does not at any time grant ownership rights over the Bit2Me Card service, the associated software, or the technological tools, but rather grants the right to use them under the described conditions, it not being understood in any case that it enables their reproduction and public dissemination, assignment, sale, rental, or loan, undertaking not to assign their partial or total use in any way, as well as not to disclose, publish, or otherwise make them available to other parties.

The user acknowledges and agrees that they have no intention of using said materials or information improperly or to harm Bit2Me in any way, or any of its affiliates.

If you see any content on the website that could violate intellectual and industrial property rights, please inform Bit2Me as soon as possible by sending an email to the address legal@bit2me.com.

  1. TERMINATION/RESOLUTION

This agreement will terminate immediately upon the closure of your account on Bit2Me in accordance with the Bit2Me General Terms and Conditions.

Likewise, Bit2Me, upon any breach of these specific and/or general terms and conditions, may suspend, cancel, or deny the provision of the service.

In the event that the account is suspended or closed and has a balance, the user has the right to recover the cryptoassets, along with the accumulated rewards on them, if any, up to the moment of disabling the account; they may withdraw them as cryptoassets or by selling them for fiat money, unless prohibited by any applicable law or by a court order from releasing them or exchanging them for fiat, including but not limited to the case where we have reasonable grounds to suspect that the cryptoassets or the funds used for the purchase of the cryptoassets were obtained through fraud or any illegal means or related to any criminal activity.

By unilateral decision of Bit2Me to no longer provide the Bit2Me Card service.

In cases of service termination or account closure, no right to receive compensation or future interest will accrue.

Bit2Me may cancel the account or the use of the card if unauthorized or fraudulent use of the card or account is suspected, as well as any other security problem or for legal compliance.

Bit2Me may deny access to the card or its use when it is considered that there is a risk of money laundering or terrorist financing, fraud, or other criminal activities. If it is necessary to take these measures, and whenever possible, Bit2Me will explain its reasons, except when the law does not allow it.

In the event that the user's Bit2Me Card account is closed, the user authorizes from this moment, to communicate, on behalf of and for the account of the user, to PECUNIA CARDS EDE, S.L.U. (PECUNPAY) the total cancellation of the products that they may have contracted with them derived from their contractual relationship with Bit2Me.

Likewise, as mentioned in clause six, the user accepts and understands that, in the event that no activity is registered in the Bit2Me Card service (purchases, payments, or any other type of transaction) for a continuous period of three (3) months, Bit2Me reserves the right to cancel the virtual card service unilaterally and without prior notice. The physical card associated with the user's service will remain operational and will not be affected by this cancellation. In any case, the cancellation will be carried out in order to maintain the security and efficiency of the service, as well as to prevent possible fraud and misuse.

In case of cancellation, the user may contact the Bit2Me support team (available at: https://bit2me.com/soporte) to request the issuance of a new virtual card at no cost in accordance with the established policies and procedures.

  1. NOTIFICATIONS

Any notification required or made regarding these Specific Terms of Bit2Me Card to the user will be considered validly received when addressed to the email listed on the Bit2Me platform or to the user's telephone number. Additionally, we may make notifications through the Bit2Me platform.

Any notification required or made under these specific terms of Bit2Me Card by the user to Bit2Me must be made through the official channels of Bit2Me such as info@bit2me.comsupport@bit2me.com, or to the telephone numbers that appear on the Bit2Me website.

  1. APPLICABLE LAW AND JURISDICTION

This contract will be interpreted and governed in accordance with current Spanish legislation.

Both parties, with express waiver of any other jurisdiction that may correspond to them, submit any interpretation or controversy resulting from this contract to the Courts that, according to the legal system, are competent.

  1. MISCELLANEOUS

  • These Specific Terms and Conditions of Bit2Me Card, together with the General Terms and Conditions of Bit2Me, the Privacy Policy, and the Cookies Policy, represent the entire agreement between the user and Bit2Me in relation to the service provided. Likewise, this agreement supersedes all previous agreements, whether written or verbal, including any statement published on the Bit2Me Platform.
  • Bit2Me reserves the right to modify or supplement these Specific Terms. Such changes or modifications will be valid and in full force from the date of their publication on the Bit2Me platform (within the Bit2Me Card service), unless otherwise indicated.

  • The user should regularly check the Bit2Me Platform and the Bit2Me Card service for such additional changes or modifications. By continuing to use the Bit2Me Card service after such changes or modifications are in effect, the user indicates that they accept the amended or modified Specific Terms. If the user does not wish to be bound by any changes or modifications, they must stop using the Bit2Me Card service immediately.

  • The total or partial invalidity of any provision or clause of these Specific Terms will not affect the validity of the whole or part of any other provision of these Specific Terms. The remaining provisions of these Terms will remain in full force and effect.

  • The failure of Bit2Me Card to exercise or enforce any right or provision of these Specific Terms shall not constitute a present or future waiver of such right or provision.

  • Providing the Bit2Me Card service does not make us a fiduciary or investment advisor. There is no fiduciary relationship between the user and Bit2Me Card.

  • None of the user's rights and obligations arising from this agreement are assignable or transferable to third parties without the prior written consent of Bit2Me. Bit2Me reserves the right to assign, delegate, or transfer this Agreement and the rights and obligations arising from it to any third party at any time, without prior notice or consent of the user.

  • With the exception of entities belonging to the Bit2Me group, a person who is not a party to this agreement has no right to enforce it.

  • Any matter not resolved by this agreement will be governed by the General Terms and Conditions of Bit2Me. In case of any discrepancy between these Specific Terms of Bit2Me Card and the General Terms and Conditions of Bit2Me, those of Bit2Me Card shall prevail.

  • Bit2Me may offset from the User's Wallet funds all direct, indirect, and acquired obligations that the user owes to Bit2Me or its affiliates as a result of Bit2Me having made an erroneous transfer of funds to an address (bank or otherwise) under their control or that of a third party provided by the user.
