1. PURPOSE
These Terms and Conditions (hereinafter, T&C) regulate the rewards program for Bit2Me Card users, and together with the Privacy Policy, will govern the relationship between the users, the Merchants (collaborators), and Bit2Me.
The rewards program is managed by Bit2Me in collaboration with the Merchants, who provide the Bit2Me platform with the available offers and promotions where the user can access rewards.
2. REQUIREMENTS FOR USING THE REWARDS PROGRAM
Persons of legal age according to Spanish law and with full capacity to contract, who are users of Bit2Me Card and accept these T&C, as well as the Privacy Policy associated with this service, may access this program.
Acquiring the status of User implies the reading and express acceptance without any reservation of the terms included in these Terms and Conditions, which you state you have previously known before accepting them, and which can be stored and reproduced by you.
For the use of the rewards program, Bit2Me will indicate the data required (such as user ID, etc.) by the merchants and which appear in the specific conditions established in these terms and conditions.
The user may access the Service through the Platform by accepting the T&C and Privacy Policy.
On the Bit2Me platform itself, the user will be able to view all available offers and promotions.
When the user makes a purchase using the Bit2Me card, the user's identification data and the transaction data will be sent.
The Merchant will inform Bit2Me whether that transaction has an associated reward and the amount of it. If there is a reward, it will be held by Bit2Me. Once the reward amount is confirmed, Bit2Me will deposit it in B2M to the user (a deposit in Fiat and an automatic exchange to B2M may appear in the wallet). This reward may take 1 to 7 days to be confirmed.
3. RIGHT OF WITHDRAWAL
In accordance with the provisions of article 103.d) of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the right of withdrawal will not be applicable to contracts whose object is the supply of goods that may deteriorate or expire quickly.
In the event that the purchase made subject to reimbursement is returned, the reward may be canceled or, if it has been deposited in the user's B2M account, it may be deducted from it.
4. EXCLUSIONS OF LIABILITY
Neither the Merchants nor Bit2Me are responsible for the products and services purchased that produce these rewards; the responsibility for the products or services acquired will depend on the Platform or business from which they were purchased, rented, or contracted.
The Merchants and Bit2Me will be released from any liability in case of improper use by the User.
The Merchants and Bit2Me will not assume any liability for damages or losses that may be suffered as a result of events that could not have been foreseen, or that, if foreseen, were unavoidable, either due to an act of God or force majeure.
The Merchants and Bit2Me are not responsible for any failure, technical error, accident, breakdown, manipulation, interruption in the Service, or any other incident that may arise in products, equipment, or technical services external to the Merchants and Bit2Me whose use is necessary for the provision of the Service.
The Merchants and Bit2Me will not be responsible in cases of unavailability of the Service due to force majeure or temporary suspension of the same for technical reasons.
5. INTELLECTUAL AND INDUSTRIAL PROPERTY
The Platform, its source code, and the contents it hosts are protected by national and international intellectual and industrial property laws. They may not be exploited, reproduced, distributed, modified, publicly communicated, assigned, or transformed, unless there is express written authorization from the rights holders.
The design, images, signs, distinctive signs, trade name, trademarks, logos, products, and services that this Website contains are protected by Industrial Property law.
Access to this Website does not grant users any right or ownership over the intellectual or industrial property rights or the contents it hosts. Users who access this Website may not copy, modify, distribute, transmit, reproduce, publish, assign, or sell the aforementioned elements or create new products or services derived from the information obtained without express written authorization.
The alteration of the content or structure of this Website by the user is strictly prohibited.
The Merchants and Bit2Me reserve the right to take appropriate legal action against users who violate or infringe intellectual and industrial property rights.
6. PERSONAL DATA PROTECTION
In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR), Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD) and any other applicable data protection regulations, we inform you that the personal data provided during the registration process will be processed and included in an information database, the purpose of which is to manage the services included in these T&Cs and to process the requests and rewards of the Users of our services offered.
To offer the Rewards Program, the following two entities act as Data Controllers:
PAYLEAD, a simplified joint-stock company, with its registered office at 9, rue de Condé 33064 Bordeaux (France), registered in the Bordeaux Trade and Companies Register (RCS) under number B 821 725 579.
BITCOINFORME, S.L. (Bit2Me), with its registered office at Calle Germán Bernacer, 69, 03203, Elche, Alicante, SPAIN, and with CIF: B-54835301.
The personal data processed for the development of this rewards service are as follows:

User ID
IP address
Bit2Me Card ID
The User guarantees that they are the owner of the personal data provided and that they are authentic. The user will be responsible for the consequences of providing false data. In case of variation in the data provided, the user undertakes to communicate it through the process enabled for this purpose on the Platform.
The data subject has recognized their rights to access, rectify, delete, limit, oppose, and port their data, for which the PARTIES are responsible. As long as the purpose of the data processing exists or you have not expressly deleted your personal data from our common Database, we will continue to process your data as they are necessary for the processing and you continue to be interested in being part of them. At any time, the data subject may exercise their rights by sending a postal communication to the PARTIES at the addresses indicated above or via email to the addresses rgpd@bit2me.com or dpo@paylead.fr, attaching a document that proves their identity and expressly indicating the right they wish to exercise.
The data subject is protected by the right to withdraw their consent for the processing of their data. Likewise, they have the right to address their claims arising from the processing of their personal data to the Spanish Data Protection Agency (www.agpd.es).
7. SPECIFIC TERMS AND CONDITIONS PAYLEADS
7.1 PAYLEAD is a Merchant that provides the user with promotions and offers with which to obtain a reward if the Bit2Me Card is used as a means of payment.

7.2 For the use of the rewards program, Bit2Me will send PAYLEAD the following personal data:

The User may access the Service through the Platform by accepting the T&C and Privacy Policy, at which point Bit2Me will send the user's User ID to PAYLEAD. When the user makes a purchase using the Bit2Me card, the "Merchant ID" and the purchase amount will be sent to PAYLEAD. At that time, PAYLEAD will inform Bit2Me whether that transaction has an associated reward and the amount of it. If there is a reward, it will be held by Bit2Me. Once the reward amount is confirmed, Bit2Me will deposit it in B2M to the user (a deposit in Fiat and an automatic exchange to B2M may appear in the wallet). This reward may take 1 to 7 days to be confirmed.
