LEGAL INFORMATION
BITCOINFORME, S.L. (hereinafter Bit2Me), with registered office at Calle Germán Bernacer, 69, 03203, Elche, Alicante, SPAIN and with N.I.F. B-54835301, registered in the Mercantile Registry of Alicante, volume 3828, folio 110, Entry 1 with Sheet A-143230, is the owner of the website: https://bit2me.com/ and the APP (iOS/Android) through which the Bit2Me Platform and the Launchpad Platform are accessed.
1. DEFINITIONS
User: natural persons of legal age and legal entities, with full capacity to contract, who access Bit2Me for the purchase and sale of crypto-assets.
Whitepaper: document with the formal offer of the issuance of crypto-assets, made by a Third Party for the issuance of service Tokens or "utility tokens" that regulates their issuance, describing the project, the type of crypto-asset, the public offer, the rights and obligations, as well as the risks associated with them.
Crypto-assets: are Tokens or digital representations of securities or rights that can be transferred and stored electronically using Distributed Ledger Technology (hereinafter DLT).
Service Token or Utility token: a type of crypto-asset used to provide digital access to a good or service, available through DLT, and accepted only by its issuer (hereinafter Token).
Cryptocurrencies or Virtual Currencies: digital representation of value not issued or guaranteed by a central bank or public authority, not necessarily associated with a legally established currency and which does not have the legal status of currency or money, but which is accepted as a medium of exchange and can be transferred, stored or traded electronically.
Crypto-asset Issuer: the legal entity or company that offers the Service Tokens or Crypto-assets to the public.
Electronic wallet or Wallet: a storage system for a user's crypto-assets and cryptocurrencies.
Initial Coin Offerings (ICOs): are the Projects or the Initial Public or Private Offerings carried out by the Crypto-asset Issuers, making them available to the public in different phases of Reservation, Pre-sale and Sale.
2. PURPOSE
Bit2Me has created a platform called Bit2Me Launchpad (hereinafter Launchpad Platform) to facilitate the reservation, pre-sale and sale of the issuances of Service Tokens made by Third Parties. This sale is carried out in advance and exclusively to users registered on the Bit2Me Platform.
These General Terms and Conditions of Contract (hereinafter, GTC) regulate the use of the Launchpad Platform, which will provide the User with access to the reservation, pre-sale and sale of service Tokens issued and offered by Third Party Crypto-asset Issuing Companies, whose projects have been previously selected by Bit2Me, and which will be exclusively accessible to its users.
All the tools, services and common aspects necessary for access to the sales process of the Projects or ICOs offered by the Crypto-asset Issuers through Bit2Me, such as, for example, the acquisition of user status on the platform, identification and authentication on it, the Know Your Customer (KYC) process, the purchase process, the transfer of funds, as well as any other necessary service or product, will be made available to the User and regulated by the Bit2Me platform through its corresponding GTC of the Bit2Me platform, which the User has previously accepted.
3. GENERAL DESCRIPTION OF THE SERVICES
Bit2Me, through the Launchpad Platform, will allow Users of the Bit2Me platform access to the Projects or Initial Offerings of Third Party Service Crypto-assets that are made available to users of the Bit2Me platform.
For access to the service, it is an essential requirement that the User accepts the corresponding Whitepaper prepared by the Third Party or Crypto-asset Issuer that regulates their issuance, describing the project, the type of crypto-asset, the public offer, the rights and obligations, as well as the risks associated with them (hereinafter, Whitepaper or TPP).
The specific particularities of the Crypto-asset issuance will therefore be specifically regulated in the applicable Whitepapers of the Third Party Projects. Specifically, the start and end date of the public offer, the minimum and maximum amount, as well as the gradual process of unlocking the crypto-asset or vesting period will be established therein. Once the process of unlocking and making the Token available is completed, the service provided by Bit2Me is considered finalized, perfecting the sale of the same, with the user becoming the owner of the Token, so that they can store it in Bit2Me or transfer it to an external Wallet that is compatible with the acquired token.
Bit2Me provides through the Launchpad Platform an environment in which the intervening Users may receive the following services:
Private Offer of the Pre-sale.
Reservation of the Pre-sale.
Public Offer of the Pre-sale.
Final sale and distribution of the tokens.
4. CONDITIONS FOR REGISTERING ON BIT2ME
4.1 Acceptance of the GTC
These GTC, the GTC of the Bit2Me Platform as well as its Legal Notice, Privacy Policy, Cookies Policy, and any other specific conditions published, are applicable to the services offered by Bit2Me through the Launchpad Platform.
These GTC must be accepted by the User to be able to use the Bit2Me services that require their prior acceptance. Non-acceptance of the GTC will make it impossible to use the services of the Launchpad Platform.
With the express acceptance of these GTC, it is understood that the User has fully accepted them and that, therefore, has previously read and understood each and every one of the terms, undertaking to comply with all the specifications established in them, which may be stored and reproduced by the latter at any time.
4.2 Requirements for becoming a User
Registration as a User of the Bit2Me Platform is an essential prior requirement for contracting the services made available on the Launchpad Platform.
Becoming a User implies the reading and express acceptance without any reservation of the terms included in the GTC of the Bit2Me Platform as well as its Legal Notice, Privacy Policy, and Cookies Policy. Registration as a Bit2Me User is an essential prior requirement for contracting the services made available by Bit2Me on the Launchpad Platform.
The User who accesses the Launchpad Platform through the Bit2Me Platform on behalf of a Legal Entity accepts and declares to have sufficient representative powers to bind the Legal Entity, Company or Professional they represent in the contracting of services, and Bit2Me will presume that it has been carried out by the latter.
Bit2Me reserves the right to modify any legal texts, which will be considered fully accepted if within one month of their availability the User does not request to unsubscribe or cancel the service.
4.3 Access Credentials
The User may access the services of the Launchpad Platform using the Username and password that will be generated during the registration process on Bit2Me.
The Username and password are strictly personal and confidential.
The user will be responsible for maintaining their confidentiality. Consequently, the user expressly accepts that Bit2Me presumes that the uses of the service made using their identification keys are made by the registered user.
The password may be freely modified by the user, through the procedures that the Bit2Me platform has established for this purpose. The replaced password will be canceled as a means of identification, at the same moment the new one is generated.
Bit2Me may block access to and use of the services of the Bit2Me Platform when it deems it necessary for security reasons. Bit2Me will adopt the organizational and technical measures in its computer equipment aimed at achieving an adequate use of the Service by Users and preventing unauthorized access whose purpose is to proceed with unauthorized disclosures of the User's financial information accessible through the Service.
4.4 Information and Documentation Requirements
In compliance with the provisions of the regulations for the prevention of money laundering and the financing of terrorism and other applicable legislation, the type of User will determine the information to be requested depending on whether they are a natural or legal person, and the interaction that the User wishes to have on the Launchpad Platform and the Crypto-asset Projects issued by Third Parties.
Depending on the service and the economic thresholds of the operations to be carried out by the User, different levels of information will be requested, in order to allow services with more functionalities and higher quantitative thresholds in the operations that the User wants to carry out.
Bit2Me, as an entity obligated by the regulations for the prevention of money laundering and the financing of terrorism, may at any time request additional information in order to learn more about the purpose and nature of the User's business relationship, and may even do so through a third party.
The lack of information or the existence of indications of Money Laundering in the data provided will allow Bit2Me to block the account and, where appropriate, the immediate unilateral termination of the service provision contract that binds them.
Likewise, Bit2Me reserves the right to precautionary suspend the User's operations and block the use of the service, until it has been able to confirm and verify the legality and legitimacy of the operations.
Furthermore, for the provision of the services object of these GTC, it will be necessary for Bit2Me to make available to the Issuers of the tokens adhered to Bit2Me the necessary information on Data Protection and Prevention of Money Laundering for the due protection of the intervening Users. This communication or transfer of information will only occur when the user reserves or carries out a pre-sale or purchase operation with the token of the corresponding Third Party Issuer of Crypto-assets.
5. GENERAL PROVISIONS FOR USE OF THE PLATFORM
5.1 Wallet Support
In order to operate on the Launchpad Platform, Users must be registered on Bit2Me and have their account active and verified, so that they can access the different Wallets located on the platform, from which they can transfer funds and buy crypto-assets. The tokens of the ICOs launched by the Launchpad Platform will be acquired and stored through the wallets that Bit2Me makes available on its Platform.
To carry out transactions on the Platform, it will be necessary for the User to have funds in their Wallet, as specified in the corresponding Whitepaper of the Project or ICO.
6. PLATFORM SERVICES
The Launchpad Platform allows access to different projects, analyzed and selected by Bit2Me, in advance, and with exclusive advantages for B2M Holders.
The specific conditions of each ICO are established in its respective Whitepaper or specific offer, with which the User wishes to interact, and must be read and accepted together with these GTC. Access to the Whitepaper for the sale of each Token is available on the Launchpad Platform.
Bit2Me provides intermediation services in the sale of the Crypto-assets offered in each Whitepaper on behalf and for the account of the Third Party Issuers of the Crypto-asset, the latter being the final responsible for the service provided by the crypto-asset, as well as the risks associated with them.
It is the Third Party Issuer of the Crypto-asset who is responsible for establishing the General Conditions of the ICO in each Whitepaper, therefore, the following services should be considered as an exemplary scheme of the services offered by Bit2Me through the Launchpad Platform.
6.1 PRIVATE SALE
Phase prior to the public sale, carried out through contracts with specifically selected clients, with particular conditions established in each Whitepaper.
6.2 PRE-SALE PUBLIC OFFER RESERVATION
Phase prior to the launch of the first phase of the ICO, it is an open reservation for all those users of the Bit2Me Platform who want to participate in them. During this phase, users may indicate the number of ICO tokens they want to reserve, within the established limits.
In order to make a reservation for future Tokens, it is an essential requirement that the User has completed the KYC process and the identification of the User's Wallet on the Bit2Me Platform.
The user must select the launch phase in which they wish to participate and the amount with which they wish to participate in the Pre-sale. The final position in the purchase will depend on the amount of B2M that the user has in the Bit2Me Wallet, and the time at which the reservation is made.
From the registration until the day of its closing, the amount with which you wish to participate can be modified, as well as the amount of B2M that allows you to advance in the ranking and secure the purchase of the tokens.
For the purchase of the tokens to finally take place, it is necessary that there are sufficient funds in the Wallet of the Bit2Me Platform to purchase the tokens indicated in the reservation. If there is not a sufficient amount of euros in the Bit2Me Wallet, the purchase of the reserved token will not occur, losing the position in the launch of the selected Public Offer.
6.3 PRE-SALE PUBLIC OFFER
The pre-sale of the Token will be configured by the Crypto-asset Issuers in different phases, identifying the price of the Token, the start and end period of the same, as well as the total capital issued in that phase and the purchase limits established for each user. The phases will end either by the total sale of the allocated capital, or by the end of the pre-sale period.
The initial Public Offers are the phases prior to the release of the tokens, and consist of the allocation of the Tokens to be issued, according to the conditions set by the White Paper of the Crypto-asset Issuer.
Once the launch phase or public offer has begun, the allocation and sale of the Tokens to the registered Users will proceed according to the conditions established in the Reservation and the White Paper. The purchase of the Token will only occur in those cases where there are sufficient funds in the User's Wallet on the Bit2Me platform to cover the purchase order identified by the user in the Reservation. The payment of the token will be made to Bit2Me through the Bit2Me platform, allocating the number of tokens equivalent to the purchase price marked by the phase in the White Paper.
It is therefore the allocation or distribution of the tokens reserved in the previous phase, which will be allocated among the participating users, based on the number of tokens reserved, and their position in the ranking, which is determined by the number of B2M tokens in the user's possession, as well as the time of their registration in the reservation. In cases where two users have the same number of B2M tokens, the priority in the pre-sale position will be decided by the user who registered first.
Once the Token has been purchased, it will remain locked for the locking or vesting period set by the Crypto-asset Issuer in the White Paper.
6.4 SALE AND RELEASE
The unlocking, distribution, and allocation of the tokens assigned in the pre-sale will be carried out by Bit2Me in the Wallets of the users of the Bit2Me platform.
The distribution will be carried out gradually following the deadlines and periods identified in the Whitepaper of the Crypto-asset Issuer.
Once the Token is unlocked and their complete release has occurred, the sale will be considered perfected, and the user may keep the tokens in the Bit2Me Platform Wallet or transfer them to compatible external wallets.
The moment all ICO tokens are unlocked and available to the user, the service offered by Bit2Me ends.
6.5 SERVICE LIMITATIONS AND RESTRICTIONS
6.5.1 Conditions and restrictions
According to the conditions established in each Whitepaper, Bit2Me may at any time, reject any exchange submitted through the Launchpad Platform, impose limits on the amounts of exchanges allowed through the Launchpad Platform, or impose any other condition or restriction on the use of the Launchpad Platform without prior notice.
Before the start of the Public Offer phases, users may change the purchase amounts and increase or decrease the conditions for the reservation. Once a purchase order or request on Bit2Me has been executed because the Public Offer has started, said order cannot be changed, withdrawn, or canceled. All purchase orders are irreversible once the Public Offer phase has begun.
6.5.2 Transaction limits
Bit2Me Users can find information regarding the limits on the Purchase amounts within each ICO, according to the Whitepaper of each one.
6.6 PRICE OF SERVICES
The service provided to the User through the Launchpad Platform by Bit2Me does not generate any commission for the user.
7. AIRDROPS
It is possible that the Issuers of each ICO, with the aim of promoting new products and use cases of a token, may reward the community of users interested in their services through Airdrops, which are operations of sending tokens to selected users.
The distribution of these tokens will be carried out as established in the Whitepaper of each ICO launched from the Launchpad Platform. The Issuers will be the ones to decide the form and conditions in which the Airdrops will be carried out, including possible lock-up or vesting periods.
To participate in the Airdrops, the Issuer may require certain actions, such as joining the company's social networks, making some kind of publication, or being a user of a platform, for example.
In no case may transfers of money or crypto-assets be required to participate in them.
Bit2Me reserves the right to shorten, extend, modify or cancel the Airdrops if she deems it convenient or if special circumstances arise that prevent their realization or if exceptional circumstances occur that prevent their completion.
Bit2Me is not responsible if any user/client does not pass the process to have a verified Bit2Me account, or if, due to a possible high demand for the Bit2Me account verification process, it cannot be completed before the date established in the Whitepaper.
The user is responsible for complying with their tax obligations in relation to the TOKENS supplied free of charge by the Issuer through the Launchpad Platform. Bit2Me is not responsible for such breaches that may occur due to the lack of communication, information or submission of the correct tax to the corresponding tax authority.
8. TAXES
The User is responsible for determining what taxes, if any, apply to the transactions they conduct through the Services, and it is their responsibility to report and remit the correct tax to the appropriate tax authority. The User agrees that Bit2Me is not responsible for determining whether taxes apply to their transactions or for collecting, reporting, withholding, or remitting any taxes arising from any transaction.
9. DURATION OF THE CONTRACT
This contract has a limited duration from its acceptance and signing, for the period that the Public Offer lasts, with its termination occurring at the moment the tokens acquired by the User are completely released and delivered. However, the User may at any time request the termination of the contract. In any case, the User may not terminate the contract until they have fulfilled all their payment obligations to Bit2Me.
The duration of the ICOs will be established in the corresponding Whitepaper, as well as the possibility, or not, of early termination.
10. GENERAL OBLIGATIONS
Bit2Me undertakes to:
Attend with the utmost diligence to all inquiries that the User may make arising from the use of the services included in Bit2Me.
Provide the service to the User in accordance with what is established in these Particular Conditions.
Keep Bit2Me operational 24 hours a day, except for temporary interruptions for website maintenance services, technical or computer problems such as internet outages caused by any reason, computer attacks, and similar situations that make it temporarily impossible to provide the service. It will be restored as soon as the incidents have been resolved.
Notify of any movement that Bit2Me may consider suspicious for the purpose of compromising the security of the User's account, for subsequent analysis.
Request any documentation and information it requires for the fulfillment of its legal obligations.
The User undertakes to:
Provide the information required in the forms in the cases indicated in this document.
Confirm the acceptance of these GTC by clicking the "I have read and accept the PARTICULAR CONDITIONS" button.
Communicate to Bit2Me all the necessary data for access and use of the services that require prior identification, which must be truthful, current, and accurate.
Create an account on Bit2Me, accepting the GTC of its Platform, as well as its Privacy Policy and Legal Notice, in order to comply with its legal and contractual obligations.
Accept the Whitepapers of each specific ICO in which they intend to intervene or participate.
Adopt the necessary security measures, both personal and material, to maintain the confidentiality of relevant data provided by Bit2Me or its partners, as well as to immediately notify Bit2Me of the loss, misplacement, theft, or illegitimate access in their name and/or their knowledge by third parties.
The User expressly accepts that any use of the service made with their access credentials has been made by themselves.
Make appropriate use of the services included in the Launchpad Platform and Bit2Me, always in accordance with the legal system.
Not to carry out any activity that hinders or interferes with the operation of the Services included in the Launchpad Platform and Bit2Me.
To be responsible for all operations carried out in their User account, as well as to safeguard and preserve the confidentiality of their credentials, exonerating Bit2Me from any liability.
Inform Bit2Me immediately via launchpad@bit2me.com of any security risk or error or defect in the Launchpad Platform that may lead to its fraudulent use or that contravenes these Particular Conditions.
11. MAINTENANCE
Bit2Me will make all reasonable efforts to ensure that the User can access the services in accordance with these Particular Conditions. However, Bit2Me may temporarily suspend services for maintenance or updates, and will make all reasonable efforts to inform the user about such scheduled maintenance. The User acknowledges that this may not be possible in emergency cases and accepts the risks associated with the fact that the User may not always be able to access, use or carry out the services.
The service may be interrupted by Bit2Me temporarily and without prior notice for those maintenance tasks that are necessary for the proper functioning of the services.
The breach of the obligations listed below by the Bit2Me User will lead to the temporary suspension of the service for the User:
The detection of fraudulent operations.
Lack of additional information necessary for the fulfillment of legal obligations.
Not accepting possible updates to the GTC or the Privacy Policies.
The suspension of the service produces the following consequences:
Bit2Me will communicate its decision to temporarily suspend your activity, indicating the reason for the suspension (unless legally obliged not to do so), requiring the actions to be taken to regularize the situation.
The User will not have access to the services during this period and therefore will not be able to perform any operations.
This temporary suspension becomes permanent THIRTY (30) days from the beginning of the temporary suspension, if your situation has not been regularized or updated with the necessary information to continue operating on Bit2Me and the Launchpad Platform.
12. TERMINATION AND RESOLUTION
These Terms and Conditions will be terminated for the following reasons:
For non-acceptance of the Privacy Policy and the GTC of Bit2Me or PCC of the Launchpad Platform: The contract will be automatically terminated.
For breach by either party of any essential obligation of the contract: the other party may unilaterally resolve this contract.
By express wish of the User: The User may decide at any time to terminate the validity of this contract, for which they must communicate their decision to the following email address: launchpad@bit2me.com.
When this contract is terminated for any reason, the User may not request Bit2Me to undo the operation or operations carried out during the duration of the contractual relationship. Therefore, no refunds of tokens sold by Bit2Me or restitution of any cash (legal tender) may be requested.
13. LIABILITY
The User ensures that they understand and have the necessary knowledge to use blockchain systems and services, and that they are fully aware of the risks associated with crypto-assets and the use of the blockchain. Bit2Me will not be responsible for any loss or gain of cryptocurrencies or crypto-assets or situations that make it impossible to access them, which may result from any action or omission of the User.
The user accepts that the purchase/sale of crypto-assets may involve a high risk, due to price fluctuations that can lead to an increase or partial or total loss of the investment. The user acknowledges the risk involved in the purchase and sale of crypto-assets, so Bit2Me will have no liability for the losses or gains that the user incurs when selling their crypto-assets.
Bit2Me does not provide any type of advice to the User in any area, whether tax, financial, economic, accounting, commercial or any other. Therefore, the decisions adopted by the User are made on a personal basis.
Exchanges in cryptocurrencies and crypto-assets are irreversible, so the User must take the utmost precautions when carrying out transactions or providing
a correct public address for their wallet. The User will not claim from Bit2Me any transaction that is sent from their User account.
The User declares to be aware of all the risks involved in the possession of cryptocurrencies and crypto-assets and therefore exonerates Bit2Me from any liability for their loss.
Any incident in the operation of banking entities will be the exclusive responsibility of the same. Likewise, any incident arising from the use of payment methods and receipt of legal tender money will be the sole responsibility of the provider thereof.
Notwithstanding the foregoing, in the event that an error may occur during operations with crypto-assets or cryptocurrencies, the User may contact the Bit2Me support service at launchpad@bit2me.com.
Bit2Me will not be responsible for the service provided by the Third Party Issuer of the Crypto-asset, whose services are regulated in the Whitepaper, which has been previously accepted by the user, and which regulates the issuance of the crypto-assets, the project, the type of crypto-asset, the public offer, the rights and obligations, as well as the risks associated with them. The Issuer of the Crypto-asset will be the final responsible for the fulfillment of the services associated with the Token or Crypto-asset, exonerating Bit2Me from any type of liability associated with its use.
14. EXCLUSIONS OF LIABILITY
The Services offered through Bit2Me comply with the provisions of the Spanish legal system. Bit2Me is not responsible for those services that do not comply with the provisions of the legal system of other countries to which the services offered through Bit2Me could be provided.
Bit2Me will not be responsible in cases of non-compliance with the terms and conditions agreed between the Issuer and the User in the Whitepapers of each token.
Bit2Me is released from any liability in case of improper use or use contrary to the legal system, the Bit2Me GTC, or these GTC, by the User.
Bit2Me will not assume any liability for damages or losses that may be suffered as a result of events that could not have been foreseen, or that, if foreseen, were unavoidable, either due to an act of God or force majeure.
Bit2Me is not responsible for any failure, technical error, accident, breakdown, manipulation, interruption in the Launchpad Platform or any other incident that may arise in equipment or technical services external to Bit2Me whose use is necessary for the provision of the Service.
Bit2Me does not assume any type of responsibility for failures in the internet network, in the blockchain of cryptocurrencies, external Wallets, or for the attack on the software of
any hacker that results in the loss or disappearance of the crypto-assets owned by the User.
Bit2Me will not be responsible in cases of unavailability of the platform due to force majeure or temporary suspension of the same for technical reasons.
The User will be responsible for the damages and losses that may have been caused to third parties, by the data provided, by way of an enumerative and non-limiting list as a consequence of the following actions:
Use of outdated, false, or unreal data.
Use by third parties of the User's personal keys and addresses.
Bit2Me does not recommend the use of crypto-assets and cryptocurrencies to people who are not fully aware of the service they are contracting and do not correctly understand how it is being provided.
Bit2Me is not responsible for the goods or services that the Tokens allow outside the Bit2Me Group environment, with the issuers of said Tokens being exclusively responsible for guaranteeing access to said goods or services.
15. ASSIGNMENT AND SUBROGATION
Bit2Me, if it deems it necessary, may assign or subcontract the contracts formalized with Users to other entities to carry out the object of the contract as established in these PARTICULAR CONDITIONS.
16. ENTRY INTO FORCE OF THE PCC
The PCC will come into force and, therefore, will be applicable to Bit2Me and the User, from the moment the following conditions are met: The User has given their conformity to them by clicking the Acceptance check box.
However, and in compliance with the provisions of article 28 of Law 34/2002 of July 11 on services of the information society and electronic commerce (LSSI), within a maximum period of twenty-four hours from the entry into force of the PARTICULAR CONDITIONS, Bit2Me will confirm the acceptance of the same, confirming the entry into force of the contract.
17. DATA PROTECTION
Bit2Me is committed to protecting privacy and providing a secure User experience. By contracting the services provided on the Launchpad Platform, the User explicitly accepts the processing of their data as described in the Privacy Policy established by the Bit2Me Group.
Bit2Me will be configured as the Data Processor in the intermediation for the sale of the tokens of the different ICOs listed on the Launchpad Platform, with the Issuer of each ICO being the Data Controller, after the User's acceptance of the White Paper that regulates the data protection aspects in the issuance of the ICO. In this sense, the Issuer and Bit2Me will sign the corresponding Data Processor contracts that will regulate access to Devteam data on behalf of the Issuer.
Bit2Me will also be configured as the Data Controller for all personal data necessary for the creation of your account on the Bit2Me Platform, in accordance with the GTC of said Platform.
Finally, the user is informed that for the provision of the service it will be necessary for Bit2Me to provide the Crypto-asset Issuers with the user's personal data necessary for the management of the ICO and provision of the services, as well as for compliance, where appropriate, with the regulations on the Prevention of Money Laundering.
18. PREVENTION OF MONEY LAUNDERING
Bit2Me fully complies with the current regulations on the prevention of money laundering and other supplementary regulations. To this end, Bit2Me informs you that said regulations require, among other obligations, to documentarily identify its Users, collect information on the nature of their professional or business activity and report, either at the request of the Executive Service of the Commission for the Prevention of Money Laundering and Monetary Infractions, or on its own initiative, any fact or operation regarding which there is an indication or certainty that it is related to money laundering.
19. INTELLECTUAL AND INDUSTRIAL PROPERTY
The System, its source code and the contents it hosts are protected by national and international intellectual and industrial property laws. They may not be exploited, reproduced, distributed, modified, publicly communicated, assigned, or transformed, unless there is express written authorization from the rights holders.
The design, images, signs, distinctive signs, trade name, trademarks, logos, products and services it contains are protected by Industrial Property law.
Access to this Platform does not grant Users any right or ownership over the intellectual or industrial property rights or the contents it hosts. Users who access this Platform may not copy, modify, distribute, transmit, reproduce, publish, assign, or sell the aforementioned elements or create new products or services derived from the information obtained without express written authorization from Bit2Me.
The alteration of the content or structure of this Platform by the User is strictly prohibited. Bit2Me reserves the right to take appropriate legal action against Users who violate or infringe intellectual and industrial property rights.
20. LINKS TO EXTERNAL PAGES
On Bit2Me you will find links to third-party websites, which are governed by their own conditions, and Bit2Me is not responsible for the operations that the User may carry out through these entities external to Bit2Me. Likewise, the Privacy Policy or GTC of these entities is external to Bit2Me, so the User must take this into account to know that both the GTC and the Privacy Policy of these third parties are solely their responsibility and not that of Bit2Me.
21. APPLICABLE LAW AND COMPETENT JURISDICTION
This contract will be interpreted and governed in accordance with current Spanish legislation. Both parties, with express waiver of any jurisdiction that may correspond to them, submit any interpretation or controversies resulting from this contract to the Courts that, according to the legal system, are competent.
22. SEVERABILITY OF ANY PROVISION
If for any reason any provision of these PARTICULAR CONDITIONS is considered null, this will not affect the rest of the provisions of the contract, which will remain in force for the established term.
