CURRICULUM OR EMPLOYMENT


Sending the Curriculum through the website or by any means to Bit2Me.


Data collected: Professional area, name, surnames, phone, email, CV, cover letter, and any other personal data associated with the Curriculum or professional profile.

Purpose: Management of the interested party's candidacy for published selection processes or other vacant positions that may arise in the future within Bit2Me's activities, in line with their professional profile.

Retention periods: The data will be retained until a job is awarded or until you request its deletion. The data will be retained for the time necessary for the purpose of the processing, and once it has ended, it will be kept at the disposal of the public administration, judges, and courts, for the legal periods established for the attention and defense of possible liabilities arising from the processing.

Legal basis: Provision of the interested party's consent or the application of pre-contractual measures at the interested party's request.

Recipients: The data provided and derived from the selection process may be transferred to: Third-party companies identified by the interested party for requesting references that may be necessary for the selection of the candidate.

The sending of information, news, notices, reminders, and promotions that may be of interest to you, related to Bit2Me's activities.


Data collected: Email address, name, surnames, telephone number, city, or country. As well as user metadata produced during their Browse (browser, operating system, IP, among others).

Purpose: The registration of interested parties for the sending of information, news, and promotions, and to establish and maintain commercial relationships.

Legal basis: Provision of the interested party's consent to Bit2Me for registration in promotional services, and the legitimate interest for the development of commercial relationships.

SERVICES


Data provided for the provision of Bit2Me's services. The services will be identified at the time of data collection and registration.


Data collected: Name, surnames, ID, contact address, home address, email, contact phone number, and other data necessary according to the requested registration, which will be exclusively necessary for registration in Bit2Me's services and the provision of services. In the user profile, you have the option to voluntarily upload a photo or avatar.

Purpose: The registration of interested parties for the provision of services and to establish and maintain commercial relationships.

Legal basis: The existing legal or contractual relationship necessary for the provision of the service and the legitimate interest for the development of commercial relationships.

Retention periods: The data will be retained for the time necessary for the purpose of the processing, and once it has ended, it will be kept at the disposal of the public administration, judges, and courts, for the legal periods established for the attention and defense of possible liabilities arising from the processing.

For the provision of certain services, such as bpay, the user may have to communicate personal data of a third party, such as the phone number from their contact list. This phone number will only be processed for these purposes, and will be done in an encrypted way, so that Bit2Me will not be able to access it. In any case, the necessary permissions will be requested prior to accessing the phonebook.


PREVENTION OF MONEY LAUNDERING


Data provided for the formal identification of the client and investigation in the matter of Prevention of Money Laundering and Financing of Terrorism by the Bit2Me companies that are considered obligated parties to comply with the regulations on the Prevention of Money Laundering and Financing of Terrorism. The services will be identified at the time of data collection and registration.


Data collected: Name, surnames, ID, contact address, home address, email, contact phone number, and other data that may be necessary for the formal identification of the client and investigation in the matter of Prevention of Money Laundering and Financing of Terrorism, including the image.

Purpose: The formal identification of the client and investigation for compliance with the Prevention of Money Laundering regulations.

Legal basis: The existing legal or contractual relationship necessary for the provision of the service, as well as compliance with a legal obligation.

Retention periods: The data will be retained for the time necessary for the purpose of the processing (10 years), and once it has ended, it will be kept at the disposal of the public administration, judges, and courts, for the legal periods established for the attention and defense of possible liabilities arising from the processing.

Communication and transfer of data: In certain services provided by one of the companies of the Bit2Me Group, with the prior acceptance of the corresponding Specific Service Conditions, the personal data that identify the user in accordance with the provisions of Law 10/2010, of April 28, on the prevention of money laundering and the financing of terrorism or any other related applicable regulations, may be communicated between the companies of the Bit2Me Group for the purpose of complying with the current regulations on the Prevention of Money Laundering. In any case, any data transfers that may occur will be communicated in the Specific Conditions of each Service, and must be accepted prior to its use.


ACADEMY


Data provided for the provision of an online training service by Bit2Me.


Data collected: Name, surnames, and email address and other possible personal data that may be for the training.

Purpose: The registration and training of interested parties for the provision of the service and to establish and maintain commercial relationships.

Legal basis: The existing legal or contractual relationship necessary for the provision of the service and the legitimate interest for the development of commercial relationships.

Retention periods: The data will be retained for the time necessary for the purpose of the processing, and once it has ended, it may be kept for a period of six years at the disposal of the public administration, judges, and courts, for the attention and defense of possible liabilities arising from the processing.

Legal basis: The existing legal or contractual relationship necessary for the provision of the service, as well as the legitimate interest for the development of commercial relationships.

Retention periods: The data will be retained for the time necessary for the purpose of the processing, and once it has ended, it will be kept at the disposal of the public administration, judges, and courts, for the legal periods established for the attention and defense of possible liabilities arising from the processing.


ACCESS AND SECURITY CONTROL

 

Data collected by Video Surveillance cameras or, where appropriate, provided for access control to the buildings of any of the Bit2Me companies:


Data collected: Name, Surnames, ID, and images.

Purpose: To control access and manage the internal security of Bit2Me's facilities.

Legal basis: Legitimate interest in guaranteeing security in the facilities by the owner, which justifies the registration of data in the access control, and that the images are necessarily captured upon accessing these facilities.

Retention periods: The data will be retained for a period not exceeding 30 days, unless it is necessary to retain it for a longer period to clarify any detected infringement or illicit act, and therefore it will be kept at the disposal of the public administration, judges, and courts, for the legal periods established for the attention and defense of possible liabilities arising from the processing.


PARTICIPATION IN EVENTS


Data collected during registration for the event, and during its development:


Data collected: Name, Surnames, ID, Email, Address, Phone number, and other data necessary for registration, as well as the image of the participant.

Purpose: To manage the development of events organized by Bit2Me and the collaborating companies, as well as the promotion of the event and Bit2Me's services.

Legal basis: Provision of the interested party's consent for registration in events organized by Bit2Me and the companies with which it collaborates, as well as for the capture of their image, name, and voice in audiovisual recordings and photographs taken during the celebration of the event.

Retention periods: The data will be retained for the time necessary for the purpose of the processing, and once it has ended, it will be kept at the disposal of the public administration, judges, and courts, for the legal periods established for the attention and defense of possible liabilities arising from the processing.

Image transfer: We inform you that during the celebration of these events it is possible that images will be taken, so the interested party gives their consent for the capture of their image, name, and voice in audiovisual recordings and photographs taken during the celebration of the event so that it can be used without temporal or territorial limit by its reproduction, public communication, exhibition, making available, and distribution in any medium of exhibition and/or dissemination, whether in person, physical, editorial, as well as by telematic networks and the internet, in any tangible or intangible, electronic and/or digital format, for commercial and promotional purposes of both companies in accordance with the provisions of Organic Law 1/1982. Bit2Me may transfer the images, or part of them, in which the person appears as a model, interviewee, narrator, or main or secondary participant in the field (whatever the internal or external communication medium), for the promotion of Bit2Me's activities, in internal or external media, so that they can be disseminated in all currently known media, including online (YouTube, Twitter, Instagram, Facebook, etc.), streaming, and those that may be developed in the future. All this with the sole exception and limitation of those uses or applications that could violate the right to honor, morality, and/or public order, in the terms provided for in the legislation in force in each country, without the right to remuneration.


CONTESTS AND SWEEPSTAKES


Data provided for registration in contests and sweepstakes organized by Bit2Me. The prizes or rewards will be identified at the time of data collection and registration, as well as in the specific Legal Bases of each Contest or Sweepstake.


Data collected: Name, surnames, ID, contact address, home address, email, contact phone number, and other data necessary according to the contest or sweepstake, which will be exclusively necessary for registration in them.

Purpose: Management and participation in the promotion, as well as the maintenance of commercial relationships by electronic means based on the legitimate commercial interest of the companies of the Bit2Me Group.

Legal basis: The consent and acceptance of the Terms and Conditions and Legal Bases of the contests and sweepstakes in which the interested party registers, as well as the legitimate interest for the development of commercial relationships.

Retention periods: The data will be retained for the time necessary for the purpose of the processing, and once it has ended, it will be kept at the disposal of the public administration, judges, and courts, for the legal periods established for the attention and defense of possible liabilities arising from the processing.


BIT2ME COMMERCE


Data provided for the use of the Commerce service.


Data collected: Email for transaction confirmation and the ID of the transaction performed, although the latter will be pseudonymized data.

Purpose: Management of the Bit2Me Commerce service. The email will be processed to perform the necessary checks for the purpose of verifying and confirming the transaction performed.

Legal basis: User consent for the use of the service offered by the business that has contracted the Bit2Me Commerce service.

Retention periods: The data will be retained for the time necessary for the purpose of the processing, and once it has ended, it will be kept at the disposal of the public administration, judges, and courts, for the legal periods established for the attention and defense of possible liabilities arising from the processing.


BEHAVIOR AND BUG RESOLUTION


Data provided for improving the experience on the Bit2Me website and App.


Data collected: IP, connection time, and user ID, in a pseudonymized form.

Purpose: Behavioral analysis for improving the user experience and resolving problems encountered by users. This data will be processed pseudonymously, and the user will only be identified upon their express request for the resolution of a fault on the website or mobile application.

Legal basis: Bit2me's legitimate interest in providing a better experience and resolving possible technical problems. In addition, user consent for the resolution of specific problems.

Retention periods: The data will be retained for the time necessary for the purpose of the processing, and once it has ended, it will be kept at the disposal of the public administration, judges, and courts, for the legal periods established for the attention and defense of possible liabilities arising from the processing.

Regarding the AFFILIATE PROGRAM, in terms of personal data protection, the provisions of the “Affiliate program terms & conditions” available at https://bit2me.uintertool.com/#/pubsingup will apply.

Regarding the REFERRAL PROGRAM, in terms of personal data protection, the provisions of the “Referral program terms & conditions” available in the web section “Legal and Policies” will apply.


BIT2ME CRYPTO API


Data provided for the provision of the BIT2ME CRYPTO API service:


Data collected: Name, surnames, ID, contact address, email, contact phone number, and other data necessary for the provision of the service. In the event that KYC is delegated, Bit2Me will process all the necessary data to comply with its obligations regarding the Prevention of Money Laundering and Financing of Terrorism.

Purpose: registration and provision of services in accordance with the configuration of the integration modules of the cryptographic tool on the Platform of the intermediary entity for the provision of the CRYPTO API service, as well as the maintenance of commercial relationships by electronic means based on the legitimate commercial interest of the companies of the Bit2Me Group.

Legal basis: The legal relationship for the acceptance of the Specific Terms and Conditions of the BIT2ME CRYPTO API service, as well as the legitimate interest for the development of commercial relationships.

Retention periods: The data will be retained for the time necessary for the purpose of the processing, and once it has ended, it will be kept at the disposal of the public administration, judges, and courts, for the legal periods established for the attention and defense of possible liabilities arising from the processing.

Communication and transfer of data: registration in the BIT2ME CRYPTO API service implies the communication of the personal data of the service to the intermediary entities for the provision of the service. These intermediary entities, which will be identified at the time of access to registration in the CRYPTO API service, are configured as Data Controllers for the data of CRYPTO API users for the verification and monitoring of the correct provision of the service. 


WHISTLEBLOWING CHANNEL/INFORMANT CHANNEL


Data provided for the management of the Informant Channel, investigation of the complaints submitted, and measures adopted for their resolution.


Data collected: Name, surnames, ID, contact address, home address, email, contact phone number, and other data necessary for the submission of the complaint, including a detailed description of the reported facts, as well as the identity of possible witnesses. It is possible to submit complaints anonymously, so they can be submitted without the identifying or contact data of the whistleblower.

Purpose: Management of the whistleblower channel and the complaints received.

Legal basis: Compliance with a legal obligation, Law 2/2023 of February 20, regulating the protection of people who report regulatory infractions and fight against corruption.

Retention periods: Your data will be retained for the time necessary to fulfill the purpose of the processing, for a maximum period of 3 months, unless due to the special complexity of the matter, it is necessary to extend it for an additional 3 months. Once the purpose has been fulfilled, your data will be blocked and kept at the disposal of the public administration, judges, and courts during the foreseen statute of limitations period for the actions that apply to the processing of your data.

In the event that an investigation has not been initiated, the data will be deleted, in any case, after 3 months from the reception of the communication.


Recipients: Your data will not be transferred to third parties, unless it is necessary for the fulfillment of legal obligations as a result of the investigation process of the complaint.


PROCESSING BASED ON LEGITIMATE INTEREST


We inform you that there are data processing operations that have as their legal basis the satisfaction of legitimate interests pursued by Bit2Me in co-responsibility with the companies of the Bit2Me Group. These processing operations are carried out after an assessment between your rights and our legitimate interest, in which we have concluded that the latter prevails, as established in art. 6.1.f) of the General Data Protection Regulation (GDPR).


You can consult the legitimate interest assessment of a processing operation at any time by sending your request to the email address dpd@bit2me.com.


Likewise, we remind you that you have the right to object to processing based on legitimate interest. You can do so through the email address rgpd@bit2me.com.


Specifically, based on Bit2Me's legitimate interest, the Interested Party's personal data may be used to protect against possible fraud and try to prevent the economic or reputational losses of such fraud, for the establishment or maintenance of commercial relationships by any means, including electronic means, about information of interest about Bit2Me's products and services, to improve the user experience and resolve technical problems, in addition to guaranteeing security in the facilities by the owner of the same. 


DATA TRANSFERS OR COMMUNICATIONS


Data may be communicated to third parties or the competent authorities, for the fulfillment of legal obligations, as well as for the provision of third-party services, which will be considered as data processors with whom Bit2Me has signed the corresponding data access contracts on behalf of third parties, having previously verified that they have sufficient guarantees to apply appropriate technical and organizational measures, so that the processing is carried out in accordance with the requirements of the GDPR, guaranteeing the security and protection of the rights of the interested party.


The user knows and accepts that the uploaded profile photo may be communicated to other users or third parties in certain processes or services implemented by Bit2Me.

EXERCISE OF RIGHTS


The Interested Party has recognized rights to access, rectification, deletion, limitation, opposition, and portability of their data. Likewise, they are protected by the right to withdraw their consent for processing by Bit2Me. They also have the right to file a claim with the supervisory authority.


At any time, the Interested Party may exercise their rights by sending a communication, attaching a document that proves their identity and expressly indicating the right they wish to exercise, to Bit2Me at the address indicated above or by sending an email to the address rgpd@bit2me.com.


TECHNICAL AND ORGANIZATIONAL SECURITY MEASURES


Bit2Me has adopted the necessary technical and organizational measures to guarantee the security and integrity of the data, as well as to prevent its alteration, loss, unauthorized processing, or access.


DATA PROVIDED


The data collected through the different enabled channels is the strictly necessary data to attend to your request, which the Interested Party voluntarily provides. The refusal to provide data designated as mandatory will mean the non-provision or the impossibility of accessing the service for which it was requested. Likewise, data may be provided voluntarily with the aim of providing the services in an optimal way. Likewise, in those cases in which third-party data is provided, the Interested Party undertakes to inform them of the content of this privacy policy.


Bit2Me reminds you that in the user profile you should not upload photographs that include your own or third-party personal information, and that you have the necessary consents and authorizations for their publication, Bit2Me not being responsible for the information included in it. In any case, the user expressly ratifies the consent for the publication and transfer of the profile image, in accordance with the provisions of Organic Law 1/1982 on civil protection of the right to honor, personal and family privacy, and one's own image.


The Interested Party undertakes to communicate to Bit2Me any modification and rectification of their personal data as soon as possible so that the information contained in Bit2Me's Activity Records is always up to date.
