LEGAL TERMS AND CONDITIONS FOR THE “FIXED REFERRALS” PROMOTION
1.- Identification of the organizing company
Bitcoinforme S.L. (hereinafter referred to as Bit2Me), with its registered office at C/ Germán Bernacer, 69, 03203, Elche, Alicante, Spain, and NIF: B54835301, has organized the promotion called "Fixed referrals" (hereinafter referred to as the promotion), which will be carried out in accordance with the provisions of these Terms and Conditions.
2.- Objective
The purpose of this promotion is to grant rewards to referring and referred users of the Bit2Me platform (accessible at https://bit2me.com and on the "Bit2Me" app for Android and iOS) for new users who register via a referral link, as well as for existing Bit2Me users, in accordance with the conditions set out in these legal terms.
Bit2Me designed this referral program in good faith, and participating users must also maintain this good faith. The intention of this program is to reward users who actively use Bit2Me's services and refer new users for that purpose. Users who violate this principle will not be eligible to participate in this program, as stipulated in section eight of these terms.
3.- Participation period
Participation in the promotions will remain active for as long as Bit2Me keeps them active on the Bit2Me platform (accessible at https://bit2me.com and on the "Bit2Me" app for Android and iOS).
4.- Rules and conditions for participation
All natural persons of legal age residing in any country accepted by the Bit2Me platform, which can be found at the following link: https://bit2me.com/en-el-mundo, who have received a formal communication through email or app push notifications, and who meet the following requirements, may participate in the promotion.
If you are not a Bit2Me user and access as a referred user, the requirements are:
Action 1. Bit2Me account verification:
Have a personal account registered on Bit2Me and complete the verification process on the Bit2Me Platform (accessible at https://bit2me.com and on the "Bit2Me" app for Android and iOS). Please note that verification can sometimes take several days and is subject to compliance with current legal regulations.
Action 2. Minimum first purchase with the Bit2Me Wallet:
Have a personal account registered and verified on the Bit2Me Platform (accessible at https://bit2me.com and on the "Bit2Me" app for Android and iOS).
Make a first purchase of crypto assets using the Wallet of the registered and verified Bit2Me account for a minimum amount, which will be specified to the user upon accessing the promotion. The first purchase must be made via card or fiat deposit. Participation by receiving crypto via Bpay or a crypto deposit is not permitted.
Action 3. Minimum first purchase with the Bit2Me Wallet within a stipulated timeframe:
Have a personal account registered and verified on the Bit2Me Platform (accessible at https://bit2me.com and on the "Bit2Me" app for Android and iOS).
Make a first purchase of crypto assets using the Wallet of the registered and verified Bit2Me account, which will be specified to the user upon accessing the promotion. The first purchase must be made via card or fiat deposit. Participation by receiving crypto via Bpay or a crypto deposit is not permitted.
The first purchase of crypto assets must be made within a stipulated period from the moment of account verification confirmation on the Bit2Me Platform (accessible at https://bit2me.com and on the "Bit2Me" app for Android and iOS). The user will be informed of the stipulated period to qualify for Action 3 rewards upon accessing the promotion.
Promotions may require the user to perform one or more of the aforementioned actions for participation. Users will be informed of the specific participation requirements when they access the promotion.
If you are the referring Bit2Me user, the requirements are:
Invite a friend or family member via the referral link in the fixed referral section of the Bit2Me app during the promotion's validity period.
Your referred user must make a first purchase of crypto assets using the Wallet of their registered and verified Bit2Me account for a minimum amount, which will be specified to the user upon accessing the promotion.
Bit2Me employees are authorized to participate in this specific promotion. Such participation is strictly personal, voluntary, and separate from the employment relationship between the employee and the Entity. Referral acquisition activities must necessarily be carried out outside working hours and without the use of corporate means, tools, or databases. Under no circumstances will the rewards received be considered salary or a supplement linked to the job position; they are to be considered a capital gain derived from a commercial action open to the general public.
To participate in the promotion, it is essential to have received an invitation directly from the Bit2Me application; otherwise, participation in this promotion or acquiring referral status is not possible.
Rewards obtained under this promotion cannot be withdrawn by the beneficiary until 30 days have passed from the date the user registered and verified on the Bit2Me platform (accessible at https://bit2me.com and on the "Bit2Me" app for Android and iOS).
Bit2Me reserves the right to make changes to the promotion during its development, should any cause arise that prevents its successful completion or to improve its progress.
Furthermore, Bit2Me reserves the right to temporarily and promotionally establish additional benefits beyond those described here. Their conditions will be communicated on the website, official blog, email, or other official company communication channels. Such promotions will be specific and time-limited and will, under no circumstances, alter the current contractual framework.
Failure to comply with these conditions will empower Bit2Me to cancel rewards and permanently exclude the user from the program.
5.- Rewards
All participants who complete the actions indicated in the promotion published by Bit2Me at any given time will benefit from specific rewards associated with the services and/or products of the Bit2Me Platform. The user will be informed of the reward obtained at the time they access the promotion, or during the account creation process on the Bit2Me Platform.
By way of example, among the rewards the user may be eligible for are the following: refunds of commissions or fees applied to operations carried out with the Wallet on the Bit2Me Platform, leveling up in the Space Center service, exclusive training videos, prizes in euros or cryptocurrencies, etc.
For certain rewards, Bit2Me Pro and Bit2Me Earn services may be excluded.
The specific conditions of each reward, and specifically its delivery, will be communicated to each user during the account creation process on the Bit2Me Platform, or once the action is completed.
Winners may waive the reward obtained, but in no case will an alternative prize be offered, nor will such waiver entitle them to compensation.
Rewards granted under this promotion cannot be withdrawn by the beneficiary until 30 days have passed from the date the user registered and verified on the Bit2Me platform (accessible at https://bit2me.com and on the "Bit2Me" app for Android and iOS). During this period, these rewards cannot be withdrawn, transferred, or converted to fiat currency. After the 30-day period, and provided that the other conditions established in these legal terms are met, the rewards may be withdrawn through the means enabled on the platform.
Rewards obtained under the Referral Program will in all cases be considered conditional promotional balance, granted by Bit2Me as an incentive within the program's context. They will not, under any circumstances, constitute a deposit, monetary balance owned by the user, or an enforceable claim against Bit2Me until the conditions for their eventual use or withdrawal are met in accordance with these Terms and Conditions.
Maintaining the promotional balance will be subject to continuous compliance with the conditions of the Referral Program, including minimum user activity in their account. In this regard, Bit2Me may establish the total expiration of the promotional balance accumulated in the referral panel in case of user inactivity for a continuous period of twenty-four (24) months. For these purposes, inactivity will be considered the complete absence of access or login to the user's account during that period. After this period without activity, the promotional balance may be automatically deleted, without right to compensation, as it is a promotional incentive subject to conditions and not funds deposited by the user.
Bit2Me is exempt from any liability in case of errors in the data provided by users that prevent their identification.
6.- Tax obligations
The bonus received by users will be considered a capital gain as provided in article 33.1 of Law 35/2006 of November 28 on personal income tax (IRPF), meaning the user will be solely responsible for their tax obligations. Bit2Me will therefore be exempt from any liability in this regard.
In cases where a withholding tax is applicable in accordance with IRPF regulations, Bit2Me will apply the corresponding withholding and make this payment on behalf of the user. In such cases, Bit2Me will send a certificate to the user stating the full amount of the prize obtained and the withholding tax applied, without deducting the amount.
Bit2Me is not responsible for any non-compliance by users that may arise from a lack of communication, information, or correct tax remittance to the corresponding tax authority.
7.- Personal data protection
In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016 (hereinafter GDPR), Organic Law 3/2018, of December 5, on Personal Data Protection and Guarantee of Digital Rights (hereinafter LOPDGDD), and any other applicable data protection regulations, we inform participants that their personal data will be incorporated into a Database owned by and under the responsibility of BITCOINFORME, S.L. The purpose and legal basis for this is the management and participation in the promotion, as well as maintaining commercial relationships by electronic means based on the legitimate commercial interest of the Bit2Me Group companies (you can consult the list of companies at www.bit2me.com).
Participants in the promotion have the recognized right to exercise access, rectification, erasure, restriction, objection, and data portability rights, which they may exercise by sending an email to the address rgpd@bit2me.com. Once the processing purpose has concluded or the deletion of their data has been requested, the data will be blocked and made available to the Administration, Judges, and Courts for the statutory limitation periods of any legal actions corresponding to the processing carried out in defense of our interests.
The participant guarantees that they are the owner of the personal data provided and that it is authentic. The participant will be responsible for the consequences of providing false data.
Similarly, participants in the promotion are informed that they have the right to withdraw their consent for commercial purposes regarding data processing by the Bit2Me Group, and they have the right to file a complaint with the Spanish Data Protection Agency https://www.aepd.es/es.
8.- Penalties for fraudulent use
Bit2Me will consider as fraud behaviors that are apparently abusive and/or malicious. Similarly, it will be understood, by way of example but not limitation, that abuse or fraud occurs when a participant identifies themselves using a false identity or third-party identities without their consent.
Should Bit2Me become aware, directly or indirectly, that the referrer may have committed fraud, abusive use, or acted in bad faith according to these terms and conditions and applicable legislation, the possibility for them to benefit from the advantages derived from the referral program will be permanently revoked.
Bit2Me is not responsible for any inappropriate or offensive content that users, at their own risk, may upload to the communication channels used for the promotion's development.
Bit2Me is not responsible if any user/client fails to complete the Bit2Me account verification process, or if, due to potentially high demand for the Bit2Me account verification process, it cannot be concluded before the end date of this promotion.
The confirmation of any of these practices will result in automatic disqualification and prohibition from participating in the promotion,
Bit2Me reserves the right to take legal action against individuals who carry out any act that may be considered manipulation or falsification of the campaign.
9.- Liability
Bit2Me reserves the right to make changes or cancel the promotion during its development, should any cause arise that prevents its successful completion or to improve its progress.
Bit2Me will be exempt from any liability for damages that may arise due to the temporary unavailability or discontinuity of the campaign's operation, the frustration of the utility that users may have attributed to it, and access to the various pages and submission of participation responses via the Internet. Bit2Me will also be exempt from the acts or omissions of participants that prevent their proper participation in the promotion's development.
10.- Acceptance of the legal terms
Participation in the promotion implies acceptance of these legal terms. Any manifestation of non-acceptance of all or part of these legal terms and conditions implies the participant's exclusion, and as a consequence, Bit2Me will be released from the obligation contracted with this participant.
Furthermore, for anything not established in these Legal Terms, the terms and conditions of the Bit2Me platform will apply.
